เรียน ท่านที่ปรึกษา
พนักงานได้ส่งอีเมล์ถึงหัวหน้าแผนก แจ้งความประสงค์จะลาออกจากงาน และกำหนดวันที่ทำงานวันสุดท้ายอีก 30 วันตามข้อบังคับบริษัท หัวหน้างานได้ตอบรับและอนุมัติให้ลาออกแล้ว และเตรียมการโยกย้ายพนักงานอื่นเข้ามาทำงานแทน จู่ ๆ พนักงานส่งอีเมล์ไปฝ่ายบุคคล ขอยกเลิกการลาออก อยากทราบว่า การลาออกในอีเมล์ครั้งแรก มีผลแล้วหรือไม่

ต้องเรียนถามว่า email ฉบับนั้นเป็น mail ที่ส่งโดยพนักงานผู้นั้นหรือไม่ หากใช่ก็ถือว่า การลาออกมีผลสมบูรณ์แล้ว เพราะการแสดงความจำนงนั้นได้ถึงนายจ้างเรียบร้อยแล้ว และการยกเลิกการลาออกโดยพนักงานก็ไม่มีผลที่จะทำให้การลาออกนั้นเป็นโมฆะไปได้ครับ ถือว่าพนักงานผู้นั้นได้ลาออกสมบูรณ์แล้ว | |
